1. These terms and your quote
These Service Terms apply to every flight, job, and deliverable provided by Red Rock Aerial Works LLC (“Red Rock Aerial Works,” “we,” “us”) to a client (“you”). Each job is defined by a written quote or work order that lists the site, the services, the deliverables, the price, and the schedule. When you accept a quote — by signature, by email, or by paying a deposit — you agree to that quote and to these terms.
If a signed quote or work order says something different from these terms, the signed quote or work order controls for that job.
2. FAA Part 107 operations
All commercial flights are conducted by an FAA-certificated Remote Pilot operating under the Small Unmanned Aircraft Systems rules, 14 CFR Part 107. Our aircraft are registered with the FAA and broadcast Remote ID as required by 14 CFR Part 89. Our Remote Pilot Certificate is current, and the certificate number is available on request.
We operate in compliance with federal aviation rules and with Nevada law on unmanned aircraft, including state restrictions near airports and critical facilities. Nothing in a quote or on this website obligates us to fly in a way that would violate those rules.
3. Pilot-in-command authority
The Remote Pilot in Command has final authority over every flight. The pilot may delay, change, shorten, or end a flight at any time — before takeoff or in the air — for safety, airspace, legal, or equipment reasons, including people or vehicles entering the operating area, manned aircraft in the vicinity, interference, or loss of a reliable link. No one on site, including the client, may direct the pilot to fly in a way the pilot judges unsafe or noncompliant.
4. Weather and safety rescheduling
Southern Nevada weather can ground a flight with little warning. We may postpone a flight when conditions exceed the aircraft’s or our operating limits, including high or gusty winds, rain, blowing dust, low visibility, lightning in the area, or temperatures outside the aircraft’s and batteries’ rated range.
If a job cannot be rescheduled within a reasonable time — normally 30 days — either party may cancel the unflown portion, and we will refund any amount you prepaid for that portion. Photography that depends on a particular light or season is scheduled for the best window we can reasonably offer, but we cannot guarantee specific sky or light conditions.
5. Airspace approvals
Much of the Las Vegas Valley lies in controlled or restricted airspace. Before each job we check airspace class, request FAA authorization through LAANC where it is available, and review temporary flight restrictions (TFRs) and NOTAMs.
- Approvals are granted by the FAA, not by us. LAANC approval is often quick, but some locations, altitudes, or times require a manual FAA authorization or waiver that can take weeks, and the FAA may deny or limit it.
- TFRs can appear at short notice for events, VIP movements, emergencies, and military activity, and can close a site on the day of the flight.
- If an authorization is denied, limited, or revoked, or a TFR covers the site, we will reschedule at no charge, propose an adjusted scope (for example a lower altitude or different vantage point), or cancel the affected portion with a refund of any prepaid amount for it.
Quoted dates and altitudes are therefore always subject to airspace availability.
6. Site access and permissions
By booking a job, you confirm that you own or control the site, or that you have obtained permission from the owner or manager, for us to access it and to launch, land, and fly over it as described in the quote. You also agree to tell us about anything at the site that affects safety, such as power lines, towers, cranes, active construction, livestock, or scheduled events.
- Neighboring property. We plan flights to stay over your site and away from neighboring property. Nevada law gives property owners a claim against drone operators who repeatedly fly below 250 feet over their land after being told not to; if a neighbor objects, we will honor it, and we may adjust or decline the job accordingly.
- Public and protected lands. Commercial filming on federal, state, or local public land — including Bureau of Land Management areas such as Red Rock Canyon National Conservation Area, Nevada state parks, and county parks — may require a permit, additional insurance, or be prohibited. If a permit is required, we will tell you before booking; permit fees and lead time are added to the quote.
- HOAs, venues, and landlords may have their own rules. Getting their approval is your responsibility unless the quote says otherwise.
We may decline or stop a job if required permission has not been obtained or appears to have been withdrawn.
7. People on and near the site
Part 107 strictly limits flight over people who are not participating in the operation. You agree to tell occupants, tenants, employees, contractors, and guests in advance that a drone flight is planned, and to help us keep the operating area clear. If people or moving vehicles cannot be kept out of the area, we may adjust the flight path, pause until the area clears, or reschedule.
Our cameras record wide views, so neighboring property, vehicles, and passers-by may appear incidentally in imagery. How we handle that is described in our Privacy Policy.
8. Client cancellations
You may cancel or postpone a booked flight by contacting us. Changes made more than 24 hours before the scheduled flight are free. Late cancellations, or arriving to find the site inaccessible, unsafe, or unprepared through no fault of ours, may incur the mobilization or travel fee stated in your quote. Fees for work already completed — such as permit applications or pre-flight planning for a waiver — are non-refundable.
9. Deliverables and turnaround
Deliverables are those listed in your quote. Our standard turnaround of 48 hours after the flight is a target, not a guarantee; mapping, modeling, and multi-day jobs take longer and the quote will state an estimate. Files are delivered by secure download link. Please download and back up your files promptly — download links expire after 30 days, and we are not an archive service, although we keep a copy of final deliverables for 12 months as a courtesy.
Unedited raw clips, outtakes, and unprocessed data are not included unless the quote lists them.
10. Who owns the footage
- Before payment, deliverables remain our property and you may use preview or watermarked files only to review the work.
- Portfolio license. Unless you opt out in writing, we keep a non-exclusive, perpetual right to show selected deliverables in our portfolio, website, and social media, with credit to us only. We never publish imagery from inspections, insurance claims, security-sensitive sites, or jobs you mark confidential without your written permission, and we blur faces, license plates, and house numbers of people who are not our clients before publishing anything.
- Raw footage and outtakes that were not delivered remain ours, and we will not license or sell imagery of your property to anyone else.
- Flight records — flight logs, telemetry, airspace authorizations, and safety records — belong to Red Rock Aerial Works and are kept for regulatory, safety, and insurance purposes.
- Third-party material in a video, such as licensed music or stock footage, is licensed to you for the uses stated in the quote and is not transferred to you outright.
11. How deliverables may be used
You are responsible for how you use the deliverables after delivery. If you use imagery in advertising, you are responsible for any model or property releases needed for identifiable people, private property, trademarks, or artwork that appear in it. You agree not to use our services or deliverables to watch, track, or harass any person, or to capture images in violation of anyone’s privacy.
12. Inspection and mapping limits
Roof, structure, and solar inspections
Inspection deliverables are visual observations documented from the air. Red Rock Aerial Works is not a licensed roofing contractor, structural engineer, electrician, home inspector, or insurance adjuster. An inspection report identifies conditions that were visible in the imagery at the time of the flight; it is not a certification of condition, a code-compliance review, or a warranty that no other defects exist. Unless the quote says otherwise, imagery is visible-light only. Have findings confirmed by a qualified professional before making repair, purchase, or claim decisions.
Mapping, measurements, and models
Orthomosaics, elevation models, 3D models, and volume measurements are produced from photogrammetry and are estimates whose accuracy depends on site conditions, ground control, and processing. They are not land surveys. They must not be used to establish property boundaries, legal descriptions, easements, or construction staking, and they are not prepared or certified by a Nevada professional land surveyor unless the quote expressly includes one. Accuracy statements in a quote apply only to the conditions described there.
13. Insurance
Red Rock Aerial Works LLC carries commercial aviation liability insurance covering its drone operations. A certificate of insurance is available on request, and where the policy allows we can name your organization as an additional insured for your job. Coverage is subject to the policy’s terms, limits, and exclusions.
14. Limitation of liability
To the fullest extent permitted by law:
- Our total liability to you for any claim arising from a job, its deliverables, or any delay is limited to the amount you paid us for that job.
- We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost sales, missed deadlines, or decisions made in reliance on deliverables.
- We are not responsible for delays or cancellations caused by weather, airspace restrictions, government action, or other conditions beyond our control.
This section does not limit liability for bodily injury or physical property damage caused by our flight operations to the extent covered by our liability insurance, and it does not limit liability for our gross negligence or willful misconduct.
15. Indemnification
You agree to defend and hold Red Rock Aerial Works harmless from claims by third parties arising from (a) inaccurate statements by you about your authority to grant access to or permission over a site, (b) your use or publication of the deliverables, or (c) your failure to obtain releases or permissions that are your responsibility under these terms.
16. Payment
Prices are fixed as quoted. A deposit may be required to reserve a flight date, and the balance is due on delivery unless the quote states other terms. Final full-resolution files are released when payment is complete. Changes in scope after booking are quoted separately before the work is done.
17. Website information
Information on this website about services, airspace, turnaround times, and capabilities is general and may change. It is not a guarantee that any particular flight can be conducted at a particular place or time, and it is not legal or aviation advice. Gallery imagery may include illustrative examples.
18. Governing law and changes
These terms are governed by the laws of the State of Nevada. Any dispute will be brought in the state or federal courts located in Clark County, Nevada. If any provision is found unenforceable, the remainder stays in effect.
We may update these terms by posting a new version on this page with a new effective date. The version in effect when you accept a quote applies to that job.
